The book Direito do Ambiente (Environmental Law) has been through successive editions – this is the 12th, carefully revised – a flattering fact not only for the author, our partner Édis Milaré, but also for Environmental Law, an auspicious branch of contemporary legal knowledge and the specialty of our office. The critical situation that is being unveiled regarding Planet Earth – threatened by global risks such as overpopulation, nuclear danger, climate change, and the increasing loss of biodiversity -, more than worrying, is a challenge for the planetary ecosystem and for the survival of the human family. This is not an alarmist outcry, as many believe, but rather a warning from science and careful observation of the facts on the five continents. The natural processes that regulate the different ecosystems are broken down and compromised. Humans’ relationships with the natural world are partly perverted, partly unfocused. In short, the environmental issue is related to the life of every one of us, and the current pandemic crisis arising from Covid-19 proves this. Governments, and particularly the national society, rightly feel concerned about this situation, which is not at all fictitious, but very real and concrete. Therefore, it is indispensable to order, or reorder, the behavior of the State and of society itself, in order to adapt legal norms and practical measures to this new and changing reality that conditions our “common home” and its billions of inhabitants. Environmental Law is asserting itself more and more and is continuously renewing itself. It is worth pointing out that Brazil has always stood out in this trajectory, serving as a reference even in industrialized and developed countries, but it urgently needs to resume its protagonism.
