1. DEFINITIONS

The following terms, when used herein, shall have the following meanings:

  • Personal data: information relating to an identified or identifiable natural person.
  • Sensitive Personal Data: Personal data on racial or ethnic origin, religious conviction, political opinion, membership of a trade union or religious, philosophical or political organization, data relating to health or sex life, genetic or biometric data, when linked to a person.
  • Consent: free, informed and unequivocal expression by which the Data Subject agrees to the Processing of their Personal Data for a purpose.
  • ControllerMILARÉ ADVOGADOS: the legal entity, under public or private law, which is responsible for decisions regarding the Processing of Personal Data, in this case, the one that granted you access as an Employee and/or User of the platform, and which hired MILARÉ ADVOGADOS to assist it in the transit and electronic management of documents in its HR, Marketing and Commercial Processes.
  • Operator: a legal entity, governed by private law, which carries out the Processing of Personal Data in transit processes and electronic document management in HR, Marketing and Commercial Processes on behalf of the Controller.
  • Handler: person appointed by the Controller and Operator to act as a communication channel between the Controller, the Data Subjects and the National Data Protection Authority (ANPD).
  • CollaboratorAll those who are invited by the Controller to register on the MILARÉ ADVOGADOS website and receive an individual and exclusive access account, to carry out all the traffic and management of the necessary documentation in HR, Marketing and Commercial Processes in this case, as a candidate to start an employment relationship, in an employment relationship, and at the end of an employment relationship with the Controller, commercial contact with students/ex-students, marketing campaigns/actions, communications/advertisements related to the service contracted/provided.
  • User: all those who use the MILARÉ ADVOGADOS website, at the request of the Controller, to enjoy and handle the controls, resources and functionalities provided by the latter.
  • Processing: any operation carried out with Personal Data, such as those relating to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction.
  • Data Subject: natural person to whom the Personal Data being Processed refers, in this case, Collaborator and User of the website.
  • MILARÉ ADVOGADOS web portal: website developed and exclusively owned by MILARÉ ADVOGADOS to carry out traffic and news management, electronically and based on the Personal Data (e-mail) provided by the Holder.

2. THE PURPOSES FOR WHICH YOUR PERSONAL DATA IS USED

As we process data as Controller, within the scope of transit and electronic news management, the purposes for which MILARÉ ADVOGADOS uses your data are as follows:

  1. Enable our newsletter to be sent out.

It is also important to inform you that by means of this Privacy Policy, you authorize MILARÉ ADVOGADOS to contact you to offer its products and/or services. In this case, we will only process the Personal Data for the new purposes of these products and/or services offered, subject to your new Consent.

3. OPTION NOT TO PROVIDE YOUR PERSONAL DATA

It is not obligatory for you to provide your Personal Data, but if you choose not to, you will not be able to receive our newsletter.

4. HOW WE COLLECT YOUR PERSONAL DATA

  1. Data sent by you The data to be sent by you is defined and configured according to the Controller’s settings, so it can be: e-mail.

5. HOW LONG WE KEEP YOUR DATA

MILARÉ ADVOGADOS will retain your data until you request its revocation.

6. HOW WE GUARANTEE THE SECURITY OF YOUR DATA

Keeping your data safe is one of the most important pillars for us. This is why we dedicate our efforts to applying and maintaining international information security standards in order to preserve confidentiality, integrity, availability and compliance with Brazilian legislation. Our employees are committed to continuously improving security controls, keeping your information safe throughout the entire data processing flow. In addition, they are subject to strict contractual confidentiality obligations and can be sued or even dismissed if they fail to comply with these obligations.

MILARÉ ADVOGADOS is committed to protecting your Personal Data, but unfortunately security is something that does not depend solely on our actions and processes, and despite all our efforts, we cannot fully guarantee that all Personal Data and information about you will be free from unauthorized access or use by third parties in your account, hardware or software failure that is not under the control of MILARÉ ADVOGADOS, as well as other factors that may compromise the security of your Personal Data.

7. WHO WE SHARE YOUR PERSONAL DATA WITH

MILARÉ ADVOGADOS may share your data in the following circumstances:

  1. Legal, judicial or administrative requirements We may share your Personal Data in order to comply with a judicial, administrative or any other legal requirement, as well as to assist government inspection bodies.

8. WHERE YOUR PERSONAL DATA IS STORED

Within the legal scope of the power of its decisions, the MILARÉ ADVOGADOS Controller may impose the storage of Personal Data in locations that best suit its operations and always respecting current legislation, so that your Personal Data may be stored on national or international servers.

9. INTERNATIONAL TRANSFER OF YOUR PERSONAL DATA

The MILARÉ ADVOGADOS Controller may request the international transfer of Personal Data. In this case, the Controller must comply with the provisions of the Law, so that, for the same reasons mentioned under “Where your Personal Data is stored”, if you need more precise information about this transfer, please contact us at the following e-mail address privacidade@milare.adv.brby following the procedure set out in the section of this Policy entitled “How to obtain more information about your privacy”.

10. MILARÉ ADVOGADOS' RESPONSIBILITIES REGARDING YOUR PERSONAL DATA

Our responsibility is to safeguard your Personal Data in accordance with the provisions of current legislation, as well as the technical standards applicable to our operation and the best practice and governance procedures established by the MILARÉ ADVOGADOS Controller. In this sense, as we act as the Controller of your Personal Data, MILARÉ ADVOGADOS is also responsible for adopting the appropriate internal security, technical and administrative measures to protect your Personal Data from unauthorized access and accidental or unlawful situations of destruction, loss, alteration, communication or any form of inappropriate or unlawful Processing, from the conception of our platform to its respective execution.

In the event of any incident arising from a failure caused solely and exclusively by MILARÉ ADVOGADOS, MILARÉ ADVOGADOS shall be responsible for carrying out the appropriate procedures to notify the affected Data Subjects, as well as the National Data Protection Authority (ANPD).

11. WHAT RIGHTS ARE GUARANTEED BY LAW

In accordance with Law No. 13,709/2018, you have the right to request the following from the Controller in relation to your Personal Data processed, at any time and upon request:

  1. Confirmation of the existence of Treatment;
  2. Data access;
  3. Correction of incomplete, inaccurate or outdated data;
  4. Anonymization, blocking or deletion of unnecessary, excessive or processed data that does not comply with the provisions of Law 13.709/2018;
  5. Portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets.
  6. Deletion of Personal Data processed with the Consent of the Data Subject, except in the cases provided for in art. 16 of Law 13.709/2018;
  7. Information on public and private entities with which the Controller has shared data;
  8. Information about the possibility of not providing consent and the consequences of refusing;
  9. Revocation of Consent.

12. CHANGES TO THE PRIVACY POLICY

MILARÉ ADVOGADOS is always looking for constant improvements. It is therefore possible that this Privacy Policy may be amended at any time. However, we will not make any changes that directly affect your rights under the law without your consent.

In order to maintain transparency at all times, MILARÉ ADVOGADOS will make available on its official website, https://milare.adv.br/, the updated version of this Privacy Policy, where it will be possible to consult the changes made to its wording.

13. HOW TO GET MORE INFORMATION ABOUT YOUR PRIVACY

Due to the provisions of Law No. 13,709/2018, it is the responsibility of the Controller to designate an Officer to provide you with all the information you request regarding your privacy and data protection. For this reason, we have created a specific communication channel for these matters, which is the email address privacidade@milare.adv.br, through which you can ask us to contact the person in charge of clarifying your doubts.

To do so, it is important that you send us an e-mail to privacidade@milare.adv.br from the same e-mail address you used when registering on the MILARÉ ADVOGADOS website/portal. In this way, we will be able to identify your account, as well as which Controller is responsible for your Privacy and Data Protection and, from this, the duly appointed Data Controller will be able to provide all the information you request.

MILARÉ ADVOGADOS only controls Personal Data for legitimate, specific purposes explicitly provided for in this Policy.

MILARÉ ADVOGADOS proactively takes internal measures to prevent the occurrence of unauthorized access, accidental or illicit situations of destruction, loss, alteration, communication or dissemination of the data stored on its platform.

MILARÉ ADVOGADOS has adopted internal non-discrimination policies and applies them in all its processes.
